Labor and Employment Law
In our more than 20 years practicing in the
area of labor and employment law, we have defended business clients
in employment matters including discrimination or harassment on the
basis of membership in a protected class (under Title VII of the
Civil Rights Act of 1964, the Age Discrimination in Employment Act
of 1967 and the Americans with Disabilities Act), and we have
handled various matters involving the Fair Labor Standards Act, the
Family and Medical Leave Act, wrongful termination, covenants not to
compete or solicit customers, and the Employee Retirement Income
Security Act of 1974 ("ERISA").
In addition to our defense of business clients, we represent and
provide advice to individuals on issues relating to employment
contracts, including breaches of covenants not to compete,
non-solicitation agreements, and confidentiality and non-disclosure
provisions. We also have experience handling cases involving
misappropriation of trade secrets in violation of the Uniform Trade
Secrets Act and breaches of contractual confidentiality and
non-disclosure agreements.
Because the defense of employment claims can be very time-consuming
and costly, we advise and recommend to our business clients that
they compile, disseminate and adhere to employment policies that are
consistent with state and federal law. We are available to assist in
the preparation of employee handbooks containing such policies.
In addition, it is important for employers to protect their
confidential and trade secret information and their customer
relationships; that can be accomplished by use of a properly drafted
employment agreement. Due to recent changes in the law, it is
necessary that such agreements be carefully drafted in such a way
that litigation is avoided if disputes arise. We are well-equipped
to draft proper agreements that are tailored to a client's
particular business needs. And, if you are an employee who has
signed an agreement containing restrictions on your right to do
business following the termination of your employment, we can
provide you with advice and counsel regarding enforceability of your
agreement by the courts.
